Search order proceedings
In May 2023, the District Court of Frederiksberg authorized an independent IT expert to execute a search order based on seized material from Measureroads laptops, including files, emails, and other materials. The court found it probable that Greenwoods software had been infringed, and therefore this execution of a search order and preparation of a search report was allowed.
Measureroad appealed the District Court’s decision (regarding the court’s instruction of the IT expert) to the High Court. In July 2023, the High Court upheld the District Court’s ruling and rejected the appeal.
The independent IT expert has now completed his search and selected the permissible material to be included in the search report. Hereafter, Measureroad requested the court to exclude extensive material from the search report. The District Court considered several objections from Measureroad, aiming to limit the material included in the search report. In October 2024, the District Court ruled that, in collaboration with the IT expert, it had finalized the scope of permissible material to be included in the search report. Measureroad has appealed this decision to the High Court.
Infringement Lawsuit
The civil lawsuit, brought before the Maritime and Commercial High Court in November 2023, involves allegations of intellectual property rights infringement, misappropriation of trade secrets and claims for damages.
During the civil proceedings, Greenwood has requested the appointment of an independent expert to provide the technical basis for the court’s assessment of whether trade secrets have been misappropriated. The court has granted this request, and Greenwood has now, in November 2024, submitted questions for the expert. Questions from both parties, along with supporting evidence, will form the basis for the expert’s opinion.
Mediation has never been proposed or sought out by either party due to the nature of the dispute.
